NHT Achieves Success at Court in Conversion and Misappropriation Lawsuit against Robert Gutierrez, Worldwide Heat Treat and Fernando Gutierrez

National Heat Treat (NHT) has achieved success in its lawsuit, pursuant to which, on August 31, 2018, NHT sued Worldwide Heat Treat, Robert Gutierrez and his brother, Fernando Gutierrez of Worldwide Heat Treat, in court. NHT has alleged that Robert Gutierrez and his newly formed operation, “Worldwide Heat Treat,” have committed various unlawful actions including Theft, Misappropriation of Trade Secrets and Confidential Information, Tortious Interference with NHT’s Business Relations, Breach of Fiduciary Duty and Constructive Fraud, Unjust Enrichment and Conspiracy (full allegations are publicly filed in: Cause No. 2018-59518 in the 11th District Court of Harris County, Texas).

Included in such alleged unlawful actions, pursuant to NHT’s allegations, is conversion of NHT’s personal property (i.e., taking NHT’s property) and other alleged dishonest and unlawful conduct, as alleged in NHT’s Petition. NHT has already achieved success; the Court issued a Temporary Restraining Order against Robert Gutierrez, his brother Fernando and Worldwide Heat Treat signed by the court on August 31, 2018, in the same case. On October 1, 2018, the court again extended the TRO which remains in effect.

The Order which can be found here: www.TRO-Orders10-22-2018.com states in favor of NHT, prohibits Robert Gutierrez and Worldwide Heat Treat from selling, transferring, using NHT’s personal property, any NHT property located at WHT’s places of business, and any NHT property located at Defendants’ residences.

Pursuant to the allegations in the suit, NHT alleges Robert Gutierrez and Worldwide Heat Treat are also tortiously interfering with NHT’s business and misleading customers, as to whether Worldwide Heat Treat is actually certified under ISO 9001-2008.
