As a consequence of the proposed 23 Portland Place refurbishment and in order to provide seamless catering services during the refurbishment period this Contract may be further extended by an additional period of 2 years.

The 23PP refurbishment will be starting in the next 18-24 months, leading to the building being closed for approximately 18-24 months. This would mean any catering supplier would likely have to stand-down their staff, and not be able to generate sales income for what would be a large part of the contract. Any new supplier would have to manage the process of transferring Lexington personnel under the TUPE regulations, and the costs and risks associated with this. Considering these factors, the contract opportunity would unlikely be financially/commercially attractive enough for potential new suppliers to submit bids. Our next step has been to explore a possibility of further extending the contract with Lexington .This option would allow us to seamlessly continue providing catering services at 23PP and would allow more time to engage and understand what our future requirements are for the catering provision at NMC venues – and in turn develop a more precise procurement strategy.
