2.Application procedure

The objective of this call for expressions of interest is to set up 3 sub-lists of pre-selected candidates for a donation of reusable and recyclable scientific equipment (laboratory equipment and furniture).

The scientific equipment to be donated has been used by the JRC and is currently stored in one of the following JRC sites:

Sub list 1: Ispra (Italy);

Sub-list 2: Geel (Belgium);

Sub-list 3: Petten (Netherlands).

Candidates may express their interest for more than one sub-list.

Expressions of interest should be submitted in one of the official languages of the European Union by regular mail to the address indicated at point 1 to the attention of Ms. Milena Muzzillo or by e-mail to the following address: JRC-R3NISP-PROCUREMENT@ec.europa.eu.

Inclusion on the sub-lists entails no obligation on the part of the contracting authority concerning the conclusion of contracts.

3.Information and documents to be provided

Interested parties should provide their full contact details and list the specific fields indicated at point 7 that interest them in their expression of interest.

Candidates shall provide a declaration on honour to be found at https://etendering.ted.europa.eu/cft/cft-display.html?cftId=5482, stating that they are not in one of the situations of exclusion listed at point 10 and that they fulfil the selection criteria listed at point 11. It is to be duly signed and dated by an authorised representative. In case of doubt, they may be requested to provide supporting evidence of non-exclusion.

Supporting evidence related to selection criteria shall be provided with the declaration on honour.

Questions relating to this call for expression of interest must be made in writing only through the above TED eTendering website in the ‘Questions and answers’ tab, by clicking ‘Create a question’. They may be sent any time during the validity of the e-notice, except for the last 3 (three) months prior to the end of validity of the lists.

4.General description of the procedure

4.1) Definition of call for expression of interest's procedure

Interested parties are invited to submit an expression of interest in accordance with the rules set out in this notice.

The contracting authority will draw up 3 (three) sub-lists of pre-selected candidates for each site (Ispra, Geel and Petten) who meet the criteria set out at points 10 and 11.

The contracting authority should evaluate the applications it has received at regular intervals (every quarter of a year).

The contracting authority shall make a sub-list of candidates for each site (Ispra, Geel and Petten) where only candidates, who met the exclusion and selection criteria set out at points 10 and 11 of this notice, will be included.

4.2) Method of invitation and award

4.2.1) Invitation:

Each time a contract of donation is to be concluded for one of the JRC sites, as described in point 7, the contracting authority will invite all candidates from the sub-list related to the involved JRC site to express their interest in the equipment to be donated. An invitation letter will be sent to all candidates registered in the sub-list. It will include an overview detailing the specifications, nature and volume of goods to be donated, specifying kind of scientific equipment and reiterating the award criteria defined in point 4.2.2 below. The invitation will also specify the modalities to visit the site where the equipment is stored. The candidates will

Be requested to confirm, specifying the items they are interested on, or to decline their interest in writing.

4.2.2) Award:

For each donation, the following criteria will be considered for the award:

1) The candidate that expresses their interest for the maximum quantity of scientific equipment being donated.

2) Present or past collaboration agreement between the JRC and the candidate;

3) The GDP per capita related to the candidate's country of residence;

4) Award criteria defined by the contracting authority of the final award.

Ad 1: The candidate expressing interest to take the majority of scientific equipment being donated will have precedence before the candidates expressing interest in a lesser amount of scientific equipment;

Ad 2: In case of unsuccessful award by application of criterion 1, as cited in the second criterion, a present or past collaboration agreement with the JRC, will give to the candidate priority to be chosen for a donation if more than one candidate is interested in taking the majority (amounting to the same number) of scientific equipment;

Ad 3: Should application of criteria 1 and 2 not lead to the award, the candidates coming from countries with lower GDP per capita will have precedence before the candidates coming from the countries with higher GDP per capita. The GDP per capita considered for the award of the contract will be the last one available, as published on the Eurostat webpage, at the date of the awarding procedure(http://epp.eurostat.ec.europa.eu/portal/page/portal/eurostat/ home/). In case the candidate residence country is not included in Eurostat database, the GDP per capita from the International Monetary Fund website will be considered.

Ad 4: Should application of criteria 1 to 3 not lead to the award, an ad-hoc criterion will be defined by the contracting authority after liaising with the Writing-off Committee from the JRC site concerned. Said criterion will ensure that the principle of objectivity, transparency, proportionality and non-discrimination are fulfilled.

The contracting authority will establish a final list of (awarded) candidates based on the above criteria. To the candidate on the first place a contract for equipment to be donated will be sent.

Should the candidate at this stage, partly or fully decline the request, the contracting authority shall be entitled to send a request to the next candidate on the list of awardable candidates.

5.Protection of personal data

6.Use of the sub-lists resulting from this notice

The sub-lists resulting from this notice will be used exclusively for contracts of the following types: contract for a donation of downgraded scientific equipment.

7.Full description of the fields covered by the call for expressions of interest

The CEI (Call for expression of interest) lists will be applicable to the Joint Research Centre of the European Commission as follows:

— Sub-list 1: JRC Ispra site (Italy);

— Sub-list 2: JRC Geel site (Belgium);

— Sub-list 3: JRC Petten site (Netherlands).

The equipment that could be donated is the following: laboratory, optical and precision equipment, laboratory pipettes and accessories, laboratory furniture, laboratory benching and laboratory pumps and accessories.

The list of equipment as above is not exhaustive. The contracting authority may add to the list new categories of scientific equipment to be donated.

8.Place of delivery

The equipment will be given away free of charge under the following conditions:

(a) the place of collection of scientific equipment shall be JRC – Ispra, Italy and/or JRC- Geel, Belgium and/or JRC - Petten, Netherlands, depending on the place where the equipment is located;

(b) the candidate will collect the goods by using their own resources and staff and under his own responsibility;

(c) all customs costs and any VAT amount due on these equipment items is borne by the candidate;

(d) equipment is given away in its present conditions, packed, without any operational or other kind of guarantee. No support is given once the donation is concluded;

(e) the candidates must keep donated equipment for use in their own activities as declared (see point 11) for a minimum period of 3 years;

(f) the contractors undertake to comply strictly with the applicable regulations on environmental protection, including with dismantling any goods, should this be necessary, and to cover any cost entailed therein;

g) kindly note that is the candidates' responsibility to immediately notify the contracting authority if any change in their administrative, technical or financial data which would result in a change to the original application during the validity of the lists (see point 9).

9.Expiry date of the sub-lists resulting from this call for expressions of interest

The sub-lists resulting from this notice is valid for 4 (four) years from dispatch of this notice.

Interested parties may submit an expression of interest at any time prior to the last 3 months of validity of the sub-lists.

10.Exclusion criteria

Exclusion criteria aim to assess whether an economic operator is allowed to participate in the procurement procedure or to be awarded the contract.

The tenderer will be rejected from the procurement procedure if it is in any of the situations listed in Article 136 of the Financial Regulation(2).

Where the tenderer is a legal person, certain exclusion situations apply also to the natural persons having power of representation, decision-making or control over the tenderer and to natural or legal persons assuming unlimited liability for the debts of the tenderer. All these situations are explicitly described in the Declaration on Honour on Exclusion and Selection Criteria.

11.Selection criteria

1) Criteria relating to legal entity

Candidates must fulfil one of the two following conditions:

(a) scientific and/or educational organisations, which are public entities or are controlled by public entities;

and/or

(b) to non-profit organisations for scientific, educational, humanitarian, social or environmental purposes means of prove:

(a) the candidate shall provide a copy of the resolution, law, decree, decision or any other official document establishing the organisation as a public body or as an

organisation controlled by a public body and/or to a non-profit organisation;

(b) the candidate shall provide evidence stating that the organisation carries out scientific, educational, humanitarian, social or environmental tasks as one of its

main objectives (e.g. the statutes of organisation).

2) Criteria relating to place of registration candidates shall be registered in EU Member states and associated countries as stated in the EU research and innovation framework Programme (Horizon 2020 and the new Horizon Europe Programme);

3) Criteria relating to future use of the donated equipment candidates shall provide a declaration on honour that the scientific equipment donated by the JRC will be used exclusively for scientific, educational, humanitarian, social or environmental purpose and for a minimum period of 3 years. During this period the contracting authority may request proof of uses declared.
