The call off contract is to be extended for an additional period of 2 years, making the expiry date 31 August 2023

Justification for the use of Regulation 72c:

• The impact of actively making significant changes to the corporate network to support remote working throughout the COVID pandemic has delayed our ability to approach the market.

• The council’s recovery from the COVID pandemic is yet to be decided but the principle of working at home for most office based workers on a more frequent basis needs to be better understood to define any approach to the market.

• 130 schools rely on consistent network services as they continue to support children working from home as children continue to isolate.

• The council will want to capitalise on the DCMS ‘lot’ for the delivery of full fibre in Denby Dale following the probable award of a contract in the second quarter of 2022.

• The overall contract remains the same.

• There is no increase in the annual contract price, therefore the modification does not exceed 50% of the value of the original call off contract

Regulation 72b is also applicable to the modification for the following economic and technical reasons:

• A seven year contract would result in exposure to significant long term commitments when the council is yet to confirm its long term plans post recovery and what assets it will retain.

• The Public Sector Network is considered to be a ‘legacy network’ and the council is currently engaging with the market as part of it’s plans to ensure we capitalise from modern technology which will underpin the next procurement.

• The council needs to avoid the impact of the change during the recovery from the COVID pandemic.
