The Kafr El Sheikh Water Supply and Sanitation Company (KSWSSC) (hereinafter ‘the Contracting Authority’ or the ‘Employer’) now announces the following changes to (a) the original contract notice for this tender procedure as published to the OJEU on 29 April 2020 and (b) the announcement of the tender’s due date extension for this tender procedure as published to the OJEU on 24 June 2020.

Reference to clause 5 of:

(a) the original contract notice (OJ/S S84/29-04-2020/198050-2020-EN); and

(b) the announcement of the tender’s due date extension (OJ/S S120/24/06/2020 290797-2020-EN).

5) Tenders’ submission deadline.

5.1) The revised deadline for submission of Tenders is set at:

No later than 12 a.m. Cairo local time (noon) on Monday 10 August 2020.

5.3) The contracting authority now grants an extension for the receipt of clarifications requests by interested tenderers. The new deadline for the receipt of clarifications is set at:

no later than 17 p.m. Cairo local time on Thursday 16 July 2020.

No further extension will be provided for the receipt of clarifications requests by interested tenderers relative to this tender procedure.

The contracting authority now informs interested tenderers that the remaining clauses of the original contract notice (OJ/S S84/29-04-2020/198050-2020-EN) remain unchanged.

The Kafr El Sheikh Water Supply and Sanitation Company (KSWSSC) (hereinafter ‘the Contracting Authority’ or the ‘Employer’) acknowledges the disruptions in the supply chains across the globe caused by the Covid-19 outbreak and their effects on project procurement. To mitigate these effects and to ensure effective procurement in terms of transparency and fair competition, the contracting authority now announces the following changes to the original contract notice for this tender procedure as published to the OJEU on 29 April 2020.

Reference to Clauses 2 and 5 of the original contract notice (OJ/S S84/29-04-2020/198050-2020-EN).

2) Provisional timetable

2.1) The duration of this contract is directly linked to the duration of design, construction, testing and commissioning of the new Zaghloul El Bahary WWTP including 1-year defects liability period and an optional additional 1-year operation and maintenance period. Therefore, the duration of the subject contract is estimated at 32 months with provisional commencement date on 12 November 2020.

5) Tenders’ submission deadline.

5.1) The deadline for submission of tenders is set at:

No later than 12 a.m. Cairo local time (noon) on Tuesday 28 July 2020.

5.3) The contracting authority has granted an extension of 20 calendar days for the receipt of clarifications requests by interested tenderers from the due date for said receipt set out in the original contract notice (OJ/S S84/29-04-2020/198050-2020-EN). No further extension will be provided in this respect relative to this tender procedure.

The contracting authority now informs interested tenderers that the remaining clauses of the original contract notice (OJ/S S84/29-04-2020/198050-2020-EN) remain unchanged.

2.Contract Description

2.1) The Kafr El Sheikh Water Supply and Sanitation Company (KSWSSC) (hereinafter called ‘the Contracting Authority’ or the ‘Employer’) have received financing from the European Investment Bank (EIB), the European Bank for Reconstruction and Development (EBRD) (hereinafter called ‘the Bank’) and the European Union toward the cost of the Kafr El Sheikh Wastewater Development Project and intends to apply part of the proceeds to finance the works contract ‘Construction of Zaghloul El Bahary Wastewater Treatment Plant, Design — Build, Defect Liability Year and Optional (1) Year of Operation and Maintenance, High Priority Cluster M.03.1, Motobas District, Kafr El Sheikh Governorate’.

2.2) The work to be carried out under this contract comprises the permanent works (facilities and systems) related to the new Zaghloul El Bahary WWTP to be designed, constructed and commissioned, the effective restoration of any defects during the 1-year defects liability period and the optional 1-year of normal operation and maintenance of the works. The contract comprises also the provision of training services to the Employer’s personnel dully completed within the defects liability period and before the works hand-over.

2.3) The average design capacity of the proposed Zaghloul El Bahary WWTP is 15 000 m3/d (9 750 kg BOD5/d), which is expected to accommodate population projections and subsequent wastewater generation up to 2 037. The second phase comprises expansion to 25 000 m3/d to accommodate population projections and subsequent wastewater generation up to 2 052. The new wastewater treatment works will be located at a land plot of 80 000 m2 acquired by the Employer and will receive influent wastewater from multiple in-system wastewater pumping stations (namely Abo Khashaba, Al Herda, Al Mahdar and Nagaa Al Slahba pumping stations). The treated effluent will be conveyed for disposal to a new treated effluent outfall discharging at Zaghloul El-Bahary main drain, which is located at approximately 1 600 m from the WWTP’s western boundary.

2.4) The proposed treatment technology for the new 15 000 m3/d Zaghloul El Bahary WWTP (in Phase A, 2037, to be expanded to 25 000 m3/d in Phase B, 2052) is the Extended Aeration Activated Sludge (EAAS) process comprising tertiary treatment for the effluent to achieve high degree of quality. The treatment process should target carbon, nitrogen and suspended solids removal, including stabilisation of sludge, in compliance to the most stringent among the Egyptian and the EU Urban Wastewater Treatment Directive treated effluent discharge standards.

2.5) More specifically, the scope of work involves the following key components:

2.5.1) design of new Wastewater Treatment Plant with tertiary treatment of a total capacity of 25 000 m3/d;

2.5.2) construction of new Wastewater Treatment Plant of capacity of 15 000 m3/d in Phase (A) comprising:

• preliminary treatment unit consisting of inlet chamber, screens, aerated grit and oil and grease removal chambers, flow measurement and any other relevant facilities for 25 000 m3/d as civil works with electromechanical works for 15 000 m3/d,

• biological treatment stage consisting of EAAS basins, secondary settling tanks, chlorine contact tank and any other relevant facilities for 15 000 m3/d as civil works with electro-mechanical works,

• filtration system (Rapid Sand Filter or Dynasand and other relevant facilities for 25 000 m3/d as civil with electromechanical works for 15 000 m3/d,

• sludge treatment and handling consisting of pumping stations, sludge gravity thickeners, drying beds and any other relevant facilities,

• treated effluent pumping station with force main to discharge the treated effluent to the Zaghloul Bahary main drain comprising all required crossings;

2.5.3) operation and maintenance training for the Employer’s staff;

2.5.4) operation and maintenance of plant facilities during the 1-year defect liability period;

2.5.5) optional operation and maintenance for one (1) additional year after the defect liability period.

2.6) The Employer now invites eligible international and/or national construction firms (‘Tenderers’), who are experienced in similar works and O&M services under similar conditions, to indicate their interest in providing the specified design, construction and commissioning works and operation and maintenance (O&M) services.

2.7) Interested Tenderers should provide all required information and documentation, as specified in the tender documents (refer to §6 hereunder), to demonstrate that they have the required qualifications and relevant experience to execute the design-build contract in question.

2.8) The Employer acknowledges the disruptions in the supply chains across the globe caused by the COVID-19 outbreak and their effects on project procurement and has taken measures in the tender documents to mitigate these effects to ensure effective procurement in terms of transparency and fair competition.

Therefore, the delivery of tender packages can be done through courier or in person, whereas attendance in person at the public opening of tenders and, subsequently, financial offers will be optional and may be supplemented by web-based remote attendance. Given the ‘greenfield’ nature of the site allocated to the construction of Zaghloul El Bahary WWTP, a pre-tender site visit will be optional for this procurement procedure, whereas all necessary information and visual material for the physical location and its surroundings are provided in the scope of the works in the tender documents. The attendance in person of the pre-tender meeting will be optional, whereas interested Tenderers are invited to submit their requests for clarifications in written form through email within the set period for the receipt of clarification pursuant to Clause 5.3) below.

3.Provisional Timetable

3.1) The duration of this contract is directly linked to the duration of design, construction, testing and commissioning of the new Zaghloul El Bahary WWTP including 1-year defects liability period and an optional additional 1-year operation and maintenance period. Therefore, the duration of the subject contract is estimated at 32 months with provisional commencement date on 14 October 2020.

4.Tenders Evaluation and Contract Award Criteria

4.1) The examination and evaluation of tenders should be executed according to the provisions set out in the tender documents, instruction to Tenderers (ITT) Clauses 26 to 38.

4.2) To be qualified for contract award pursuant to instruction to Tenderers (ITT) Clause 39, Tenderers must demonstrate to the Employer that the minimum administrative compliance requirements for ‘Administrative Qualifications’ and for ‘Technical Qualifications’ are substantially satisfied. The evaluation of administrative compliance will be executed on a ‘Pass’ or ‘Fail’ basis. The ‘Administrative Qualifications’ requirements comprise:

(a) general documentation,

(b) eligibility,

(c) historical non-performance and litigation, and

(d) financial situation.

Whereas, the ‘Technical Qualifications’ requirements comprise:

(a) experience (General, Specific and ESHS Certification/Documentation and Experience),

(b) personnel,

(c) equipment, and

(d) subcontractors.

Only substantially responsive tenders (i.e., tenders that fully satisfied/passed the above administrative compliance requirements) will be subject to further evaluation of technical conformity and competence.

4.3) To be qualified for contract award pursuant to instruction to Tenderers (ITT) Clause 39, Tenderers must demonstrate to the Employer that the minimum requirements for technical conformity and competence are substantially satisfied. The evaluation of technical conformity and competence will be executed based on the following criteria in decreasing order of importance:

— technical solution maximum score: 550 Minimum Score: 400

— Tenderers’ performance guarantees maximum score: 150 Minimum Score: 100

— structure and organisation maximum score: 150 Minimum Score: 100

— personnel and equipment resources maximum score: 150 Minimum Score: 100

Only substantially responsive tenders for technical conformity and competence (i.e., tenders that have fully satisfied the minimum scoring requirements of detailed technical evaluation) will be subject to further evaluation of financial proposals.

4.4) Pursuant to instruction to Tenderers (ITT) Clause 39, the Employer shall award the contract to the Tenderer whose tender has been:

(a) affirmatively determined to comply with the administrative compliance criteria and requirements;

(b) affirmatively determined to comply with the technical conformity and competence criteria and requirements by being substantially responsive to the tender documents and who has offered the lowest evaluated tender price and therefore, is expected to implement the contract satisfactorily.

5.Tenders’ Submission Deadline

5.1) The deadline for submission of tenders is set at:

No later than 12 a.m. Cairo local time (noon) on Monday 29 June 2020.

5.2) The Employer should not consider any tenders received after the deadline for submission of tenders pursuant to tender documents ITT Clause 23.1). Any Tender received by the Employer after the deadline for submission of tenders shall be declared late, rejected and returned unopened to the Tenderer.

5.3) Any requests for clarification should be received by the Employer no later than 28 calendar days after the date of publication of this invitation to tender to the Official Journal of the European Union.

5.4) The Employer reserves the right to accept or reject any tender and to annul the tendering process and reject all tenders at any time prior to contract award, without thereby incurring any liability to Tenderers. In case of annulment, all tenders submitted and specifically tender securities, shall be promptly returned to the Tenderers.

5.5) After the tenders submission deadline and until contract award, no correspondence of any type shall be entertained, unless called for by the Employer.

6.Tenders’ Submission Details

6.1) Tenderers should prepare one (1) original of the documents comprising the tender, as specified in the tender documents data sheet ITT Clause 20.1) and clearly mark it as ‘ORIGINAL’. In addition, Tenderers shall submit four (4) copies of the tender and clearly mark them as ‘COPY’, plus an electronic copy in CD.

6.2) In the event of any discrepancy between the original and the copies, the original shall prevail.

6.3) Tenders must be submitted in English and in written form,

— either by recorded delivery (official postal service), in which case, the delivery record makes proof of compliance with the time-limit for receipt (refer to § 5.1 above), or

— hand-delivered or through courier services in return for a signed and dated receipt, in which case, the acknowledgment of receipt makes proof of compliance with the time-limit for receipt (refer to § 5.1 above).

6.4) Tenders submitted by any other means, including electronic submission, will not be considered.

6.5) Tenderers submitting tenders by mail or in person should enclose the specified original and copies of the tender in separate inner sealed envelopes, which should be enclosed into one single package, pursuant to the provisions of the tender documents ITT Clause 21.

6.6) If envelopes and packages are not sealed and marked as required, the Employer will assume no responsibility for the misplacement or premature opening of the tender.

6.10) The Employer will conduct the tenders opening in public session where the attendance in person of the Tenderers’ designated representatives will be optional and may be supplemented by web-based remote attendance. In any case, tenders opening will be held at the address specified in § 6.8 above and at 12 a.m. Cairo local time (noon) on Monday 29 June 2020.

6.11) Interested Tenderers are invited to obtain the full tender documents for the design — build contract in question from the contact person/conference coordinator at the address specified in § 6.8 above upon payment of a non-refundable fee of EGP 10 000 or equivalent in a convertible currency that shall be paid in cash in Kafr El Sheikh Water Supply and Sanitation Company treasury.

6.12) All tenders must be accompanied by a tender security of EGP 2,500,000 or its equivalent in a convertible currency with a validity of minimum 180 calendar days plus 28 calendar days.

6.13) Note that only tenders submitted pursuant to the requirements specified in the tender documents will be considered. The evaluation will be carried out solely on the information submitted in the tenders. Any additional information not mandated by the provisions set out in the tender documents will not be considered, although the tender evaluation committee may request Tenderers for clarifications. All procedures will be carried out pursuant to the provisions of the tender documents that has taken into consideration the EIB Guide to Procurement dated December 2018 and the FIDIC Yellow Book ‘Conditions of Contract for Plant and Design Build’, first Edition, 1999.

6.14) A site visit will take place on Wednesday 27 May 2020 and a pre-tender meeting will take place on Thursday 28 May 2020 both commencing at 10 a.m. Cairo local time at the address specified in § 6.8) above. The attendance in person of the site visit and the pre-tender meeting will be optional. All necessary information and visual material for the physical location of Zaghloul El Bahary WWTP and its surroundings are provided in in the scope of the works in the tender documents. Interested Tenderers are invited to submit their requests for clarifications in written form through email within the set period for the receipt of clarification pursuant to Clause 5.3 above.
